Bankrupts with a single mortgage will not be left with nothing.
January 29th. /MEDIA TALK/. The State Duma approved in the first reading a law providing additional protection for property owners. The draft law provides for the possibility of saving part of the funds from the sale of a single residential area, including that which is mortgaged, in the event of bankruptcy.

It is assumed that the money received after the sale or confiscation of residential premises by the bank will no longer be fully transferred to creditors, some of it can be used to purchase a new smaller home. As Sergey Gavrilov, head of the State Duma Committee on Property, Land and Property Relations, told reporters, he was quoted by TASS as saying that if the housing was sold for 5 million rubles, and the cost of organizing the auction amounted to 100 thousand rubles, then 90% of the amount remaining after the sale (4.41 million) would go to repay the debt to by the bank. The remaining tenth will be divided equally – half (245,000) goes to the creditors of the first and second stages, the other half goes to the bankrupt person himself.

If the court finds that a citizen has concealed the existence of other real estate or overestimated the value of his only home, the amount that will be owed to him after paying off all debts may be reduced.
